What are my rights after filing chapter 7
My ex-wife and I filed chapter 13 before our divorce and then after the divorce I converted to a chapter 7 to release me from all of the debt. My ex-wife kept the mobile home but I still get late payments hits on my credit report when she doesn’t pay. I notified the Bank of their mistake and they informed me there wasn’t a mistake, and stated that I can get out of the debt but they can still make life miserable for me. Is there a law to protect me from creditors messing with my credit? Thank you……
Re: What are my rights after filing chapter 7
The creditor is allowed to report factually correct information. If the payments were late, and you were a signer on the loan, then they will continue to show up on your credit report when the payments are late.
Your beef should be with your ex wife.
If you want to write a statement explaining things from your perspective, the credit bureau is required to include that letter when someone asks for your credit report. That might make you feel better and take some of the sting out of the report.
But if you already have a bankruptcy on your report, late payments aren’t going to make your credit look that much worse, especially if you can explain that someone else is making those late payments after your responsibility for payments ended.
Hope this helps!
