Tenants rights when being harrassed by another tenant
My fiance and I live in Glendale, Ca., in a 4 apartment building. Over 1 year ago a new tenant moved in and has been harrassing not only us, but the landlord as well. She was on a 1 year lease, but her lease expired in Oct. of ’06, and she is on a month to month basis. The landlord keeps saying she is planning to evict her for constant harrassment, but has done nothing. This woman is mentally ill, and has been harrassing us constantly. We live directly across from her. She has called the police on us 2 times, and has left us and the landlord disturbing letters. We have contacted the police to see what our options are and they keep telling us it is a civil matter. They also tell us it is the landlord’s responsibility to protect their property and tenants. I feel the landlord isn’t doing enough to protect our rights to a safe living enviornment and we do not know what to do anymore. We have lived in our apartment for over 5 years, and never had any problems with our other neighbors. I think this other tenant has done this sort of thing before, and has called the health dept, & city on the landlord to make her look like a slumlord to protect her place in the apt. But what about our rights?I feel the landlord isn’t doing enough for us
Re: Tenants rights when being harrassed by another tenant
The landlord may be breaching your lease’s implied covenant of quiet enjoyment. You can try to seek a rent break because of it. Also, if you feel that your safety and well-being is endangered, you can file a civil harassment restraining order against the tenant or a lawsuit for nuisance. They’re not great remedies, but it could get her attention. The only other solution is to give your landlord a 30-day notice and relocate.
