We are in the 7th month of a year lease and our landlord has placed the home up for Sale. What are our legal rights, as tenants, in this situation and once the property goes up for sale does the lease automatically turn into a month to month contract?

The new owner would have to honor the lease. However, don’t be surprised if they offer you a buyout before the lease is up. Either owner could give you a 30-day notice a month before the lease is up if they want you out. If they don’t do that, then it will turn into a month-to-month rental under the same terms. Good luck.

Your legal rights include:
(1) The old owner must honor the lease on its original terms as long as he is the owner;
(2) The new owner must also honor the lease on its original terms until it expires;
(3) Both owners have legal duties to account for your deposit.
