My husband and I bought a house together, and we have now split up. He has agreed that I will keep the house, as we bought it from my Mom.With the quit claim, does he still have rights to this house?Taxes? My Mom is going through the same thing, and has moved in here w/me.I would like to re-finance, but I am on an FHA 30yr fixed at 5.5%, and everyone that I have talked to says that I would not be able to do better than that.W/ the FHA loan, I have to pay mortgage insurance(about $84 monthly)Would it do me any good to refinance w/a conventional loan at about the same rate,to avoid mortgage ins.?My ex does not want to be held responsible for any part of the house, and I don’t blame him!Any suggestions would be appreciatd, thank you.

real estate title and quit claim deed
I divorced in January ’07; I would like to change the title of the home my ex-husband and I are trying to sell from joint tenants w/rights of suvivorship to joint tenants in common so my will be in effect if I should die (ie, the proceeds from the sale of the home will be disbursed according to my will). Can I file a quit claim deed from myself as a joint tenant to myself as a tenant in common without having to get my ex-husban’s approval (which he won’t give)?

I have a divorce decree. Wife is to receive funds from refinance of residence. Wife must sign quit claim deed prior to closing refinance loan, which frees up money to be granted to her according to the decree.
Problem: Neither she, nor her attorney will respond to ANY of my inquiries about the matter. I’ve relieved my attorney of her duties. All that is needed is simple compliance with decree directives. I have 60 days to comply with orders, but cannot get needed cooperation, i.e., signature.
I’ve sent emails, certified letters, phone calls, contacted the judge’s office to no avail.
What can be done? I’m hamstrung.

My sister was diagnosed this summer with a stage 4, inoperable brain tumor that has impaired her visual, motor and reasoning capacity, especially after a recent round of treatment. She is named executor of our parents’ estate (they are very elderly but still living independently). I am named second ”alternate” in their power of attorneys, wills and living wills. She seems reluctant to hand over executor to me although it is apparent that she will not be able to fulfill her responsiblities. My concern is the length of time it would take to have her declared incompetent should something drastic happen to my elderly parents and a decision be made immediately. What is the process and approximately how long does it take to go through this process?
