Tenant signs a year lease from 8/07 to 8/08 and then signs addendum from 8/08 to 8/09. It’s now 12/09. Tenant wants to give 30 days notice to landlord to move out.
Landlord quotes first lease language as “The lease shall not be extended automatically from month to month upon the same terms and conditions as set forth in this Lease. Either of the Parties may give at least 60 days written notice of intention not to extend or to renew this Lease. If the Lease is extended, 60 days prior written notice by either Party shall be required to terminate this Lease. This notice shall be received no later than the first day of the month and the tenancy shall terminate on the last day of the month. Should tenant fail to vacate as scheduled, the per diem rent rate will double”.

Tenant never gave notice to renew lease in 8/09 and Landlord never gave notice to extend or renew lease in 8/09. Language of first lease seems to say that there will be no month to month after lease term ends but also seems to say that Tenant or Landlord MAY give 60 days notice not to extend or renew, not that it is required.

If Tenants kept living in apartment and Landlord didn’t request a renewal or extension of lease, do Tenants need to give 60 days notice to vacate?

I have a month to month lease.

I have a month to month lease.It states if i am 2 months delinquent with rent i can be evicted immediately.I owe 700 for Jan(out of 1200).And 1200 for feb and now 1200 for march.I gave my 30 day notice to vacate by April12th,as it states i can give 30 day notice to vacate.The landlord is saying that he can remove me immediately,without going to court,just basically saying i will be removed as of March 31st.he also harassed my visitors the other day saying they were blocking the driveway.They were not,and they were just dropping my son off at home,and were in the driveway less than 2 minutes. I am on disabilty as well and am basically trying to vacate and go on a payment plan to pay the remaining rent.The landlord wants no part of it and is saying i will have to leave march 31st.Does he need to go through the courts to eveict me or can he just kick me out?I live in Va.

Back in February I had 2 tenants living in my rental property on a month to month lease with the understanding each would pay half the rent and utilities a piece, that if either left they would be required to give a notice to such effect. One of my tenants left without such notice and have left many of their belongings in the rental property and have not come back to claim such property since the first of February.

Since I have no contact information and no known residence of where they live now, the courts will not let me execute a writ or possession or warrant of debt for unpaid rent, because there is no known address to serve court papers to. Can I as the landlord now claim the property left behind as my own legally, or what course of action do I have to dispose of the processions that were left behind?
