Hello,

My landlord would like me to sign another year lease but I prefer to go month to month. On April 1, I will have fulfilled the year lease. I also had a previous lease with this landlord on the same unit, and have lived here a total of 4 years.

My current lease states under ”Notice of Termination”: ”Upon 30 days’ notice before the contract end date or thereafter, for good cause, Tenant or Landlord may terminate this lease.”

It also states, under ”Holdovers”: ”If Tenant holds over on termination of this lease and Landlord accepts Tenant’s tender of the rent provided by this lease, this lease shall continue to be binding on the parties as a rental period to rental period agreement.”

It also states: ”No changes, additions or subtractions from conditions of this agreement shall take effect unless mutually agreed upon in writing.”

He also raised the rent, which I assume he is able to do without me signing a new lease. Thanks.

I signed a 6 month lease with a June 30th termination date. At my choosing, I could continue the lease on a month to month basis. Early in the month of June I advised them that I did not need to hold over. I was told that I had to give 30 days notice of my desire to terminate and that my lease now extended until July 31st. There was a totally ambiguous statement about notification in the lease, but it was never pointed out to me or required that I initial to acknowledge the consequences. When I said that this was material to the contract and should have been pointed out, they said that it was too bad and that they were within their rights to charge the money. It seems to me that this is totally to the benefit of the landlord. The lease had a clear termination date, why was it not honored? What’s the point of having it if it isn’t honored? It should be that it terminates unless I advise otherwise. This is that it continues unless notified. The landlord is trying to catch people. I vacated at the end of June and they had all of July to refurbish and get it ready for rental. I received a bill for the month. What is the law on the subject? Thank you.

I recently gave 60 day notice on my lease so that it would not automatically renew. When I did turned in the notice, I told the leasing agent on duty that I would be very interested in going month to month. They told me that would be fine but no paperwork was filled out. I recently called back just to follow up and they told me the apartment had already been rented. Do I have any kind of squatter rights? or am I required to move out now?

There is a possibility that he will have to be put in a nursing home .
My question is what will happen to my father’s house. my brother (age 52)
is severely mentally retarded and lives in my fathers house. I take care of
the both of them. My Sister has general power of attorney over all my fathers
affairs and is also my brother’s LAR. Our question is , is it possible for my
sister (who has general POA) to get the deed to the house ? He has no will or testament.

I am recently married to a philippine national. We currently are awaiting her visa application so that she can enter the U.S. In the mean time, I own several rental properties and wish to sell one. My real estate agent tells me I must have my wife’s permission to sell the property, even though it is only in my name. Does this apply given that she is a foreign national who has never been to the U.S. and currently cannot legaly enter? Will a general power of attorney assigning me as her agent but executed in the Philippines and notorized by a Philippne notary be accepted in the US for this purpose? How best should I proceed?
