Hello. My sister had been renting my house in Dallas Texas for about three years. For the last two years she hasn’t been paying me the complete rent which equals the mortgage amount. Now she has completely stopped paying me and she doesn’t want to pay anymore (she quit her job). I want to rent the house to another tenant but she refuses to show the house either. She doesn’t want to move out. What are my options to gain control of the house? I am in the military and this house is legally considered my second home.

We were recently taken to small claims court by our former tenants for their full deposit back. We had proof of obvious damage to many areas of our house but because we made a verbal agreement to end the lease one month early, the judge said that since the tenants gave us the keys on the third of December, we had thirty days from that day to give them a report on the property. We followed the lease agreement which ended on the thirty-first of December which stated that we did not have to give a report on the property till the fourth of January. Since we waited till the fourth, the Judge said we had to give all the money to the tenants. Is a verbal agreement more binding than a lease agreement? Do we have a case to appeal?

Reletting Fee VS. Remainder of Lease Agreement
I just moved out of a rental house in Texas. I did have to break my lease agreement. I received a letter from the real estate agent handleing the releasing of the house. It states that for reletting the contracted lease agreement for the address, my $1000.00 security deposit and my $450.00 pet deposit will not be refunded, due to breech of contract. Now, the landlord is also wanting me to continue paying rent until the house is released. I was under the impression that in the state of Texas a landlord my charge either a reletting fee or the remainder of rent, but not both. Can he charge me both a reletting fee and still continue to charge me rent until the house is released?
