In April 2009 I decided not to renew my annual lease on my boat slip and advised the marina. I asked them if they would consider a month to month until I was ready to move and they agreed. In September I went back in because they were over billing me above the quoted amount and they made a billing adjustment. On December 30 I moved out and advised the marina in writing that day. They responded saying I owed the balance of the year because when I was in their office in September they advised of this and he had it in his computer notes. I never agreed to anything but a month to month and have never signed anything. Am I liable for the extra four months ?

I have a tenant that has informed me that she is moving. She has not given the 30 day notice we spoke of originally. She also says that she will need to stay and or keep belongings in the house for an additional 2 to 3 weeks but she is not willing to pay rent for the month of October, or even a prorated amount for the time she spends in the home. If here month to month agreement is terminated by here and ends September 30, is it reasonable for her to believe she can remain in the house for up to 20 days in October rent free? The local judge says that if she is not out on the first, that I can legally start eviction proceedings but the process may take up to 15 days. If that is the case I might as well just let her stay the extra five days. How can i go about collecting the rent due for October if she is not out by the 1st?

Landlord wants full last month’s rent
Gave written notice on 12th of the month to vacate no later than 12/15/03. Landlord demands full rent on 12/1. I am on a month to month lease after 3 successful, no problem year leases with this landlord. I point out there is no specific statement in lease about giving notice on the last day of the month or any other ”specific” date and therefore chapter 91 Texas Property Code applies outlining rent owed to the 30th day after notice give (12/15 in other words). Landlord disagrees. How can I communicate this point of law without angering landlord?
