They won’t move
I leased a home for 6 months. After the lease expired, it just became a month to month as the lease was not removed. On December 2006, I informed the tenant in person that I needed the house back as my wife and I where moving back in. I told them that I needed the house by the end of Feb. 2007. I even told them that they did not have to pay the Feb.2007 rent in an effort to help them put a deposit on a new place. On Feb. 27, 2007, I visited the tenants and was informed that they were closing on a house within 10 days. I went back on March 8, 2007 and was told by that the house fell through and were getting another house in 2-3 days due to repairs. I visited them on March 11, 2007 and was told that they were not getting the house until March 20, 2007. They don’t seem to be in a hurry to move. I need the house asap. What should I do next? I feel that they were given enough notice to move and have been living their for free for all of Feb and now March.

This question is actually for a neighbor of mine. During Hurricane Ike they recv’d a note stating that they had to move out by the 26th when they already paid rent for the whole month. There was no notice given to them and they weren’t prepared to move. They were told they were to give a 90 day notice to the Landlord if they were going to move and they hadn’t done that because they were wanting to stay…plus we were hit by Hurricane Ike, so moving would be impossible right now. They didn’t give them any notice at all. Can they do that, just evict them like that on a Month to Month and tell them that they have to move out at a certain date without notice? I mean these people just went through a hurricane, they are family of five with three kids all under the age of ten. It just doesn’t seem right or fair that they would do that to them. The note was posted to their door on the 17th of September, just after Ike hit the Houston area, they were without power for 6 days and expected to move out by today. That gave them no time to pack and no time to look for a place to live since Hotels are full around here and no one seems to be renting, just repairing.

Using the Deposit as Last Months Rent
I have rented from a lady for the past 16 months. For the first 12 months we had a written lease agreement but it expired in 9/04. Since that time, we are renting month to month. When we rented the house, we gave the landlord the first months and last months rent. We have tried contacting the landlord regarding giving our 30 day notice to vacate but she has not called back. Can we legally use the last months rent paid up front as the last months rent payment?

Unpaid Marital Debt
My husband’s ex-wife has not paid her portion of the marital debt from their marriage. She had a credit card (in my husband’s name) that was awarded to her that unfortunately was not paid off prior to the end of their marriage. We are now going into 5 years of escalted harasment and letters from the credit card co.due to her stopping and starting payments. This is the only black mark on my husband’s credit and is affecting it. We know the credit co. does not recognize the decree. Decree states she was to inform and hold harmless. She has never informed per the decree. She has only paid $1100 off in 5 yrs. We have certifed letters from his ex flat out lying that she sent payments and will pay the debt and gets her stories mixed up. To date she has made 1 payment in a year. We have offered her two alternatives to pay it off (she received a $42k inheritence in 1999 that we can prove)or for her to consolidate her debt. Ex continues to lie and harass us. Will a San Antonio court do anything about this or will we be the victims of the law? I refuse to pay the remainder of this debt, $5700, would it be worth even pursuing in court? We need help or solutions to get her to pay this?
