My father is divorced and in his papers it states that we owns half of the house he lives in and my mother owns the other half. My husband and I moved in with my father 2 years ago to help take care of him because he is sick. He told us that we are to get his half of the house. He typed up a letter stating this. It says “I ____ do on this date of February 02, 2007 leave all my worldly goods and possessions to ___ and ___ This letter is signed and notarized. I just want to make sure this is a good legal document and will hold up on court if need be. I also have a signed and notarized general power of attorney.

My Aunt, who lives in Tn but whose will is registered in Fl has left 3 nephews out of her will. She has included 5 neices and 1 nephew who is a co-executor along with one of the neices. The aunt is senile. Is there a way for the 3 nephews to contest the will for inclusion as beneficiaries with equal standing. Secondly, is there a way to determine from the will why the 3 were left outl. The one executor nephew refuses to acknowledge that a will exists or where it is located. He does have a general power of attorney to handle the Aunt’s affairs. The Aunt is still living. My sister, one of the neicies, told me in front of her husband that she would divide her share equally with me if I am not included in the will. Is this enforceable?

In August of 06 when my mother is seriously ill by brother who was named executor of her estate obtains general power of attorney, possible using undue influence. He then has himself listed as beneficiary (Payment on Death) on a number of her CD’s. He does not inform me that he had obtained POA or had himself listed as POD on the CD’s. A month after my mother dies (Sept 07) he notifies me of the above and sends me a copy of a notarized document stating that all CD’s where he is listed as POD is to be shared equally with myself, him, and my sister. He does not reveal any details of the values of the CD’s. He makes no distribution to me of any monies in the year and a half after my mother’s death and I now have ever reason to believe he not going to willingly do so without me having to file a civil suit to compel him to do so.

Under what civil torts might I pursue a suit?

Currently the will has been filed but not yet probated. I could try and get the assets brought back into the estate based on undue influence upon a person who is failing mentally. I think my brother would have a very difficult time explaining why as executor it was necessary to take the action of listing himself as POD to begin with.
