Final Account – Closing the Estate
I am the Personal Representative of my uncle’s estate. I am closing the informal probate. Does Minnesota law state that I must send the ”Personal Representative Statement to Close Estate” and the ”Final Account” by law to every devisee in the will? I am concerned that one of the other devisee’s will know what I am receiving from the estate and taking as a fee and will gossip. All of the individuals will not be a problem, but one is a charity to which I belong – can I not send the Final Account to this one devisee and just send them their check with the Receipt, Release and Indemnity? What is the law on this?

Our trustee resigned. They paid themselves a termination fee 4X their normal annual fee. They also paid out, on the last day, attorney retainers – 5X there annual fee. They told the benificiaries that they would return the retainers (but not the termination fee) only if we signed a global release to hold harmless. Is this leagal?

My grandma died 4 years ago. In her will, she left me ”five acres or the cash equivalent”. My mom is the executor of the will, and trustee of the trust. The will and trust have never been filed at the court. The trust leaves everything to my mom and uncle. We have always assumed I would get the ”cash equivalent”, because they would not sell me the house with the property. There are no other assets in the trust (just the house and attached acerage.) I just found out that they are selling the house to my sister on a land contract (no money down, payments to be ”whatever she can afford.”) Since they will not be getting a lump sum of money in selling the house, how could I get my money? Also, mom once mentioned that they had a quit claim deed signed by grandma from years ago that wasn’t recorded. If this gets recorded, making the house hers and my uncle’s, does that mean the trust has no assets to pay me, and I get nothing?

Improper attorney conduct
Father died in 2005. Had trust with mother who is 90. 2 sons to inheret all. Two bank accounts and house worth over 900k. After father’s death the attorney who did the trust started to visit mother weekly. Mother, no school, from Syria, and knows nothing about trusts etc. signs anything the lawyer asks her to. Several changes to the trust has been made, including removing one of the sons as executer. A general power of attorney has also been signed by mother. Mother now wants nothing to do with the sons and will not show them any bank statements. Attorney will not talk to sons. We filed a complaint with the state bar to look into this situation. What will they do? Can they force an audit of the bank accounts?
