Transferring Home Ownership to Family Caretaker
My husbands parents have been wintering with us in NYS for nine years. We now think they are no longer able to use their PA home, and therefore will be with us all year from now on or until they need nursing home care. Would it be best to transfer ownership of their real property in PA to my husband, who has a 1990 General Power of Attorney in PA and also a 2002 Durable Power of Attorney in NY?

Lease Agreements and Breaks
My roommate has decided to move out of our apartment, which we signed a 1 year lease to in August. I have not violated any rules according to our lease. She would like me to sign a form to break her from the lease. I would like to know if there is any way she would have to pay her half of the rent untill I found another roommate? or any other advice to this matter!

We have been living at the same address and rented it for the last 3 years. But only signed a one year lease, the first year. We never signed anything else after that year was up. We have been offered a house elsewhere but need to move into within a week or two otherwise we will lose it. I gave the landlord notice on the 20th that we will be out by the 1st of Oct. and she said that we are to give them 30 days notice as bound by our lease, the lease has been standing for three yrs even though we never signed a new one. And to pay the rent for the month of Oct and are responsible until the 20th of Oct. for the apartment. Our we bound by this agreement? I asked if she could just keep the security deposit as long as the apartment is in good shape (they know it is they are here all the time and my husband was the ”maintenence” guy for him.they said no it is illegal. Is that also true? Where do we stand?

I live in PA and I just recieved eviction papers in the mail from the magistrate. On the papers the landlord wrote that I waived my notice to quit as per lease agreement. My problem is that I never signed a lease. I read that he has to post on my property that I have 30 days to move or pay(he never did this) and then he can go to the magistrate and file for eviction. Is this true, and if so what can I do about this? Doesn’t he have to provide proof to the court that he followed proper procedure before they give him a hearing date?

Our written lease agreement states no pets. Before signing the agreement, we told the landlord we do have a dog and he agreed to let us still rent the place. Foolishly, we did not change the written lease agreement. The landlord has been to the property several times over the last 2 1/2 years, played with the dog, never once indicating anything was wrong. Will the oral agreement stand? Is there any “implied” agreement being that the landlord was fully aware of the situation, and never showed disapproval?

Also – in the case of damages. What cost is the tenant responsible for? If work can be done by tenants or landlord at a reasonable cost, but the landlord still decides to contract a more expensive professional (ie. landscaper) – what cost is the tenant responsbile for?

Are landlords required to give a heads up on damages, if they have inspected the home before the tenants move out? To give the tenants time to try and fix the problems.
