I paid a $475 cash sec deposit to a prospective landlord who was ”too busy” right then to write me a receipt(he was doing repairs on the apartment), I agreed to get the receipt and the lease agreement when I would next see him. One week later I became financially unable to rent the apartment, I told him immediately and he said he would return my money as soon as he rented the apartment to someone else. That was 9 weeks ago, I have made numerous contacts with him to get the money or a receipt, he now refuses to even answer the door or take my calls. I want to take him to small claims court for the money, as stated, I have no receipt, but I do have a recorded conversation in which we discuss the money and he admits he owes me, the exact amount and that he ”can’t pay me right now”. Would that work as evidence in court and can I sue for additional money that I had to borrow to replace that money? thank you.

I moved into my apt. 6 months ago with no lease agreement. I’m moving out and my landlord has told me that it is New York state law that I am reqired to give 30 days notice. Is this true? Also, I withheld my last month’s rent assuming that my security deposit (which equals one months rent) would be applied as rent. The apartment is in far better condition now than it was when I moved in, but having no documentation of this, I was afraid my landlord would keep the deposit without any real reason. My reason for moving out, if it makes any difference, is that after 6 months my landlord still has not made many repairs that he promised me before I moved in, including some that I think may be fire code violations. Please let me know what my obligations are. Thanks.

Dear Sir & Madam,

I owned a 2-family house and there is no lease agreement with tenants.
If I want my tenant to move out and the reason is I want to keep the apartment for personal use. Does the tenant has any defense not to pay rent & refuse to move although she has a job? If I have to bring her to court when she stop paying rent, is it a long process to get her out?
I heard that I have to send a notice of petition to the tenant 30 days in advance, what is a notice of petition?

1. My tenant currently has a month-to-month lease. The apartment is on market now. Per our lease agreement Landlord may show the apartment to possible buyers(at reasonable hours).I am out of state. My tenant failes to
cooperate with my broker.
2. On Janury 15 I sent(cirtified mail) to my tenant written notice of termination with 30 days prior notice and asked him to vacate the apartment on February 28.
He sent me a check – February payment.I have not deposit it yet. My broker explained if I accept this check the tenant supposed to vacate the apartment only on March 31.
Per my understanding security depost is not considered as a monthly payment. It is like a damage security… will be
returned after inspection.
