We own a store and out landlord send us a notice that the lease was not execute properly. He had given an old agreement to his attorney, which does nto comply to their rules. We had re-signed an agreement 2 times after the original date and prior to commencing of store renovation. the last copy was notarised as well. Now the landlord clains that he does’nt have the latest one and that the old one still is valid. He also mentioned that file is missing now and verbally said that he will accuse us for the file being missing. I need a few clarifications on that:
1. If a lease agreement is signed a few times which one is considered legal.
2. If the landlord accuses taht he had lost the file, who will be charged for that, since we do not have access to thier files.
3. He is threatning us by saying that all thsi can be gone if we do a favor to thier relative, who is also one of our partner. What do we do in this situation?

I have a Durable General Power of Attorney for my husband who has senile dementia. It was signed by him five years ago when he was competent. The Substitue Agent designated at that time was my son in law who is presently divorced from my daughter. Can I change the substitute agent without my husbands consent or do I have to draw up a new document and perhaps have guardianship papers drawn up as well since my husband cannot sign documents at this time.

Power of Attorney Durable Provision
I am filling out a power of attorney form that I purchased at Staples, a ”general power of attorney” from ”Made EZ Products”.

One of the ”areas of authority” reads as follows, with a box for my initials that represents granting of this area of authority to the attorney-in-fact:

Durable Provision
(P) If the blank space in the block to the left is initiated by the Grantor, this power of attorney shall not be affected by the subsequent disability or incompetence of the Grantor.

I would like to understand the implications of granting vs. not granting this area of authority to my stated attorney-in-fact. Basically, what does this mean, in laymans terms?

We are under contract on our home. We had the attroney review (which is a 3 day process) and on that Monday after review i got a call from my realtor telling me the buyers want to back out of the contract. My realtor told them no cuz we were under contract. So they pulled in a homeinspector. A few things came up (both cosmetic and not, but nothing majo) and i agreed to fix everything on there except for a few small cosmetic issues. They came back and said that was unacceptable and that they went out. Again we told them no because we are under contract. They have an approval from their mortgage co and only have about 3 items left to get per their mortageg co and they will have commitment. But they told the mortgage co not to move on cuz they were not buying. Then we go the last letter i recieved from them said they wanted out, they wanted their deposit money back ($1,000), they told their landlord to renew their rental agreement, and then attacked my realtor for not being able to sell my home and that is why i am giving them a hard time. There is so much back and forth and i need to know what my rights are. They are under contract, don’t they have to continue on with the buying of my home? what about the depsoit they keep asking 4?
