Trying to purchase a house with a tenant that won’t vacate
I have a friend who has signed an agreement on the purchase of a home. A deposit has been provided. A loan is secured. The tenant won’t vacate. I implored him to request a copy of the lease agreement. The settlement date can not be set until the tenant vacates. What are the laws surrounding this issue? How can we get the tenant to vacate? Who is responsibile for enforcing the tenant to vacate? The home was on the market for 40 days prior to signing the agreement, so the tenent was aware of a pending sale. My friend entered into this agreement under the pretense of being in the home in less than a months time. He is purchasing this home to reside in. What advice can be given? He is ready to walk away from this agreeement. Thank you.

Inheriting a rental property
My mother-in-law recently passed away. She owned a condominium in a resort town near the Jersey shore which she left in my wifes name in her will. For the past year or so, she was renting the condo out to a nice couple who always pays there rent on time. And my mother-in-law never had any problems with these tenants. My wife wishes to sell the condo but she isn’t familiar with the ins and outs of being a landlord and doesn’t wish to start now. The only other information that I can provide is that we do not believe that the tenant never signed a lease. Although my mother-in-law did draw up a lease agreement when they first moved in, she had told me a while ago that he never signed this document. Our questions is ”Whah recourse do we, as new landlords have? We wish to sell the condo but don’t know how to go about asking him to move out. How much notice do we have to give him by law? Should we hire an attorney to handle this matter? Your assistance with this matter would be greatly appreciated.

Recently sent registered letter lease to tenant; returned undelivered. Prior to mailing lease had both tenants read lease on my PC. It was a year’s lease agreement. Since moving in and paying 1st month’s rent, tenant called on 12th of month asking, “where’s the frigging lease” and, later in the conversation mentioning he hadn’t sent the check, but I would receive it by end of week, even if he had to send it express overnight mail. The check didn’t arrive Friday or Saturday and Monday’s a holiday-the 18th. My plan is to send the “good” tenant a “month to month” lease instead of the original lease they read on my PC. Is there an implied “lease” contract for the original year’s lease, or, because the tenants ignored the post office’s repeated attempts to get the tenant’s to sign for the registered letter either at the door or at the post office, can I now send the tenant/s a month-to-month lease to sign? Also, if they refuse to sign a month-to-month lease does that automatically place them on a month to month rental basis. Note: state of agreement-New Jersey. Any advice will be welcomed. Thank you.

Tenent to Landlord
There are 3 apartments and I found out that I am sharing my water heater with the basement apartment and I am paying there half of the water bill. I am also paying the inside hallway, garage and outside lights on my electric bill. For the past year I have been paying this. I sent a letter that I am moving out on 4/30/07. This was not disclosed on my lease agreement. What can I do?
