This question was asked and answered by a Calif. resident.
Question: What is the procedure of evicting a tenant that is living on a month to month basis with no contract? Also how many months or days are we required to give them ?
Reply: A 30 day notice is given if they resided less than a year and 60 day if more than a year. Then an unlawful detainer complaint is filed. Please contact our office and we can answer to questions. 714 363 0220. Reply Posted By:

Does this answer also pertain to New Jersey? If not what legel rights do we have. We rented our house to a couple who the Husband was a friend of ours at a very low rental rate $600 per month in this areas all houses the going rate is $1000 and up per month. The couple caused a few disturbances ,she had a restraining order and he finally moved out. Now we want the house back to rent it in relation to the proper fees in this area. We also need to do some refurbishing.
