Question: What is the procedure of evicting a tenant that is living on a month to month basis with no contract?Also how many months or days are we required to give them ?

Does this answer also pertain to New Jersey? If not what legel rights do we have. We rented our house to a couple who the Husband was a friend of ours at a very low rental rate $600 per month in this areas all houses the going rate is $1000 and up per month. The couple caused a few disturbances ,she had a restraining order and he finally moved out. Now we want the house back to rent it in relation to the proper fees in this area. We also need to do some refurbishing.

I am 24 yrs. old and rent a room in a private home in New Jersey. There is no written lease; I pay month to month. My landlord will not allow me to have any guests, male or female, at any time of day. I find this rule to be extremely unreasonable and have told the landlord as much. The landlord’s reply was that because it is her private home and we share a front door, the landlord will not ever allow a guest (esp. one of the opposite sex). Isn’t it my right to have the occasional guest, especially if we are not being bothersome?

I have tenants that want to purchase the house they are renting from me. Though they have bad credit, they pay and have paid excellent/ on time for 2 years. My mother told me to consider a ”land contract”. Could you please tell me what is that, how would it benefit me, and what could I expect in cost to have an attorney draw up the contract? I have a mortgage- first and second on the property with equity remaining.

Power of Attorney – which form to use
There are a number of power of attorney forms. One is a General form and the other that I am questioning is called a Durable Power of Attorney. My husband has Parkinson disease along with dementia. Most of the time he is compentent, but there are times when he sort of goes to his ‘own place.’ Would the General Power of Attorney be effective if he does not have the ability to understand information. If I use the Durable form, is it only effective if he is unable to handle information or communicate coherently. Which form best suits a situation where a person is sometime coherent and other times not?

Restriction on use of driveway access
Leasing residence since 12/99. Residence is one of two with a common driveway running from the front house to back. No one in front house for four months had unrestricted use of driveway since onset of lease.Lease agreement says nothing about acess. New tenants move into front house and we are advised by them and the landlord that only the front house occupants have use of the driveway and we must park on the street. Real estate firm leasing to us never advised of any restrictions of this kind. Help!Help!
