Divorce Settlement
In my divorce papers in 1994 in Detroit, Michigan, there was to be a quit claim putting the home in my name, which was done; and when the home sold I was to pay my ex $20,000 which was 1/2 of the equity at that time of the divorce. The home has not sold. Actually he is living in it right now. He has made a few updates to it. I have remarried. I think it would be right if at this time the home should be in joint ownership (him & me). He is actually having papers drawn up at this time; however, if I do this, I want to be absolved of having to pay him the $20,000 that the court originally ordered. I don’t want to very kindly give him 1/2 of the house and then be stuck having to pay him the $20,000 if he gets a hair crossed or something. I think it’s a fairly easy thing to do another quit claim, but I won’t sign anything unless I have been absolved of the original $20,000 and I’m not sure a simple paper by an attorney can do that. I have a feeling that there needs to be another court order absolving me of that. Help! (and thank you very much for it!!)

Bought a home with a land contract owner went to jail when he got out he needed money he quit claim deeded house to me we had it witnessed, notarized and recorded with our county office. Now he says he did not sign and wants us out in 30 days, I have deed here.

Married for 8 years. I owned the home since 1990. My husband received a lump sum buyout/retirement in 2007 of $140,000, foregoing all health care benefits. We signed a post-nup stating in case of separation he will quit claim the house to me, which he has, and in return I will stay married to him so that he can have my health insurance. I did not receive any of his buyout money due to this agreement. Now he has decided to file for Divorce. The post-nup also states if HE filed I would not be responsible for his health care but if I filed I would be. Now he says that he should be entitled to some of the equity in the house. Does this Post-nup stand up in court? Would adultery play a part on the courts decision? He is also trying to force me to re-finance the home immediately. I retired in 2005, and not sure if I can qualify at this time due to my fixed income. He was having the affair when all of these decisions between us were made. I would have kept my $50,000 a year job had I known all the facts. I stand to lose quite a bit of money due to legal fees, refinance costs and possible equity. I also started a business, but currently at a loss. I could lose my home. I am planning on hiring an atty. but would like your thoughts.

I hold DPOA on my Father. His Nursing Home bill was not paid in full as would not provide detail summary of care and disputed amount due and owing. Father was moved to another home due to abuse he received at this facility. They are now suing me for his past bills at this nursing home. Am I liable for my Fathers debts?

I have a General Durable Power of Attorney over my mother and she has been widowed and remarried since it was signed. Her last name has changed. Is the document still legal or do we need a new one?
