I rent an apartment and a friend asked me if she could stay here for ”a couple days”. This was almost 2 years ago. Does she have any legal right to remain if I tell her to move out? Do I need a ”30-day Notice to Quit” as if I were a landlord? What sort of legal action can she take against me? Does Massachusetts have a ”common-law” marriage? My name is on the lease but she has been splitting the rent with me. Please help. Thanks.

As of May 31st we have been evicted from our apartment. We are current on rent and have not violated any of our lease aggreement.The landlord came to our house and gave us a notice to quit. He said that the Dracut police department went to his house and told him they are doing a drug raid of our apartment because they have been watching us for months and they have pictures and surveillance of us drug trafficking. He also told us he doesn’t know when the raid will happen so we should get out as quick as we can because DSS will be here and take the kids away. We went to the Dracut police department and spoke with someone about the allegations and they said they have absolutely no police reports from this address or anything about drug trafficking. Those are really serious allegations. We were also told by the police station he didn’t even serve us a legal eviction notice. What rights do we have? Should we fight this?

Myself and my wife are having yet more problems with my landlord.

We have just been issued a notice to quit, based on non-payment of rent. However, we have a bank statement that confirms the cheque has been cashed and deducted from the account.

This, I’m sure, is a misunderstanding on the landlords end, however, given that 2 months ago we got her cited for 5 health code violations, I believe this is retaliation for this event. Also, she has still failed to correct 1 of the violations.

What is your advice on the best course of action we should follow?

my situation is: I have sent a notice to quit to the tenants in my 2 famiy home for non-payment of rent which was delivered by a constable:they had 15 days to move out…they still have not left. I then had a constable deliver a 2nd notice in which they are summons to appear in court… Now my question is: they owe $3,350.00. I know I am going to get judgement for them to pay rent that is owed, but my fear is since I just recently found out that they are illegal they will eventually move out, not pay what they owe and continue to rent from someone under a different name and therefore iI will not be able to find them to collect. Is there any way I can change the locks and keep there things until they pay or ensure some way of getting what is owed?

Tenant Violates Lease Landlord Gives Notice to Quit
I had a tenant rent and move into a room in my apartment in August 2007. Since then the police were called to the apartment twice for noise complaints, he sexually harassed me, heavily damaged the floors with scratches, and refuse to clean or maintain the apartment in a reasonable manner. I gave a notice to quit citing that the tenant was in violation of sec. 11 of the Massachusetts Standard Fixed Term Lease (which was signed by both parties). The tenant moved out within a few days and is demanding return of security deposit, which I will return minus a percentage of the cost of floor repairs and cleaning. I want to know if however I want to know if I can demand reasonable damages for part or the remainder of the lease under section 25 of the lease?
