Does a Living Trust Need Letter of Acceptance from Court
I am the Trustee of my mother’s (Massachusetts) Living Will and she has passed. She has an account with ING Direct that is included as those assets covered by the Trust. ING tells me I need a Letter of Acceptance from Massachusetts Courts. Part of that acceptance is bonding by two Massachusetts real estate owners. I live in New Hampshire and don’t know any MA residents. I was under the impression that Letters of Acceptance were part of probate.

My father is terminally ill with abdominal cancer… doctors are not sure how much longer he has – in November of 2008, they gave him 6-months – today, he is still functioning (cancer is growing slowly), and we can only hope he has another year.

My concern (question) is that he is very private person, and will not talk about anything…. he won’t even tell us what he wants after he passes away (memorial service, funeral, burial, cremation, etc…he just says do what’s in your heart, which is very difficult for us). He does not have a Living Will nor does he have any desire to create one.

My parents divorced 30 years ago, and he never remarried – it’s just me and my sister. His parents have passed away, and he has one estranged brother. When I asked him about a Will – he said there’s no need for one because the law will divide his money and property between his two children, and it’s as simple as that… Is this true?

Any advise is greatly appreciated during this difficult situation we are faced with.

My husband wants to adopt my children, we have to wait to see if my ex (boyfriend) agrees to this. Someone told me however, that I should have a living will drawn up , that states, if something should happend to me, that my children are brought up by my husband? Is this true? My ex, has no rights to the children as of present, except of course that he is their biological father. There is nothing in writing that he or any court has that he has any legal right to these children.

Hi-I have legal will in existence along with a living will re medical decisions etc. I have named a niece as executor. Despite this, relatives of mine are insisting it will be to everyone’s benefit to draw up a trust. They tell me this will avoid my property getting hung up after I pass. I’m confused as to why, since I have a legal, binding will, that a trust is necessary. Or maybe I just don’t fully understand what a trust is. Help.
