I recently bought a car and it turned out to be a lemon so I stopped payment on the check. I have talked to the previous owner of the car and let him know and he is willing to re-sell the car. I want to be as fair to them as possible and I don’t know how to go about the title. If I let him sell the car and I make the title out to the new owner am I still legally bound to the car. For instance it was the transmission in the car that is bad if the previous owner sells the car and doesn’t tell the new owner that is is going to come back and bite me in the butt? Or am I clear as long as the bill of sale says “as is”?

my 14 year old son traded a 2002 k x 85 dirt bike for a 1997 yamaha blaster got it home and didn’t run right only got to ride it for about 30 minutes. I called the guy told him the situation and he said he would come get it. He did now he’s saying it’s going to cost me 700.00 to fix this 4-wheeler. the bill of sale says 1 1997 yamaha blaster trade even for 1 2002 k-x85 + labor and lawn care & painting will work off balance. this does not say as is. Is this something i could take to small claims court?

Can a person be quit claim deeded onto title without knowing? And then some years later the property be sold – still without them knowing until they receive their tranfer tax bill from the state of Maine? The disbursment check made payable to me, from settlement, was forged. I never would have known I was an owner, then the seller – had it not been for the tax bill I received. Does this sound legal?

Overturning a power of attorney
My 81 year old mother lives in Florida with my unemployed brother. My mother has had all the signs of dementia in recent years, but has never been to a doctor. (she refuses) Last year, unbeknownst to the rest of the family, my brother had gotten her to sign over ”power of attorney” to him and he also took out a $30,000 loan on her fully paid for house. He then never paid a mortgage payment and the house was up for foreclosure in less then a year. None of us were aware of this until a family member spotted it on the on-line official records for that county. I reported all this to elder abuse, but the Department of Children and Families who handle the cases were very negative and unhelpful. The house was saved by a third party, but almost 1/2 of the equity was lost and the $30,000 was never accounted for though there is good speculation it was used for my brother’s back child support. Right now, I am only interested in getting my mom up to Maine to live here in an assisted living residence. She seems to want to do that too. First of all, will it be hard to get this durable power of attorney overturned? Secondly, isn’t what my brother did exploitation and punishable in a court of law?
