NH eviction Laws
Because I was a few months late on paying off my rent, my landlord has decided to evict me a week before the lease is up. Now he gave me a notice to quit AND an eviction notice in the same day, but he has not involved to county sheriff or the courts in the eviction. Is it legal for him to do that? Can he legally evict me without any notices either from the sheriff or delivered by a sheriff?

Retaliatory Notice to Quit
I have been given a 30-day notice to
quit my month-to-month tenancy after
complaining to my landlord about:
1). decrease in services without
compensation
2). late payment penalty (I’ve never been
late but he instituted a $65 penalty
effective immediately if rent is not paid
on the first day of the month)
3). repeated violation of my quiet
enjoyment, as defined in my rental
agreement.

Further, I’ve been given a 30-day
notice, dated 2 November, delivered on
3 November, requiring my vacating the
premises by 1 december. Can I move
this matter to court without having to
wait for a notice to evict?

Translation of and questions about non-payment notice
The following is an unintelligible notice i received in my mailbox (w/o an envelope). I would appreciate an opinion as to whether such wording is standard as it’s almost laughably offensive.

(case and punctuation left as is)

14-DAY NOTICE TO QUIT FOR NON-PAYMENT OF RENT

TO: (ME)

Your rent being in arrears, you are hereby notified to quit and deliver up in fourteen days from receipt of this notice the premises now held by you as my tenant namely:

(My address)

PAST DUE RENT FOR THE MONTH OF: JULY (July being crossed out with black pen and APRIL being written above) $1375 PLUS $25.00 FOR SERVICE OF THIS NOTICE

TOTAL DUE: $1400.00

HEREOF FAIL NOT, or I shall take due course of Law to eject you from the same.

(signed by someone unknown to me)

From what i understand, without paying the written amount i can be removed from the house in two weeks. Keep in mind this is a poor photocopy that was just dropped in my mailbox and the rent amount isn’t even correct.

This notice is also dated April 4th, and my rent is due on the first of the month; isn’t there some sort of legal wiggle room where i’m given a certain period of time to comply, especially when i’m without prior problems?

landlord tenant
soon after making complaints to local, state and federal depts. on the condition of the place i was living was the landlord began to retaliate for filing notice to quit, shutting off power, breaking and entering (which criminal report was made) and taking possesions just to name a few. we were recently in court and the judge asked if i would like to file a counterclaim against him as some serious laws have been broke, i said i would. the judge said i have 21 days to file the responsive pleadings with the courts. what exactly do they need for me to file the countersuit (responsive pleadings)? is there a special court form i need to fill out or do i just need to respond in writing with a desription of the events and the amount i would like to be rewarded? also, the landlord had from day 1 requested a jury trial for this matter and the judge said that discoveries are to be completed by 4/23/09. what exactly is that? if i can get some answers it would be much appreciated as i have tried to contact local legal aid and have not gotten any response back and only have 9 days left to file this counter, and just do not have the extra money to hire an attorney at this point. thanks
