How do i go about notifying tenants that im taking over as manager and maybe giving a 60day or 30 day notice to move or raise the rent again in less than a year if possible when there was only an oral month to month rental agreement in a city were there is no rent control. id like to do things the legal way and write up a month to month agreement. we rent 3 units to relatives so my husband would always have them pay rent way way below the fair value and didnt charge them security deposit or anything. they all have been renting for more than 3 yrs we have installed new carpets twice, repainted twice, had to extenseivly clean the apartments before we repainted put in new expensive tile in all. to tell the truth we are destined to lose our property if i dont take charge and help ourselves instead of the tenants!

I am buying a duplex that is currently rented….I want to move into one of the units that is occupied with a month to month lease…..can I give them a certain amount of time to move? They are old and retired and I hate to do it, but if I buy it I want to live there….what are my options?

I have a tenant that was on a verbal month to month lease. This tenant has recently decided to move giving me a 2 weeks verbal”only” notice. Their was also a verbal agreement made in December that the tenants would be resigning the lease for the following year. Should this tenant receive any or all of the deposit money back. The tenants have not paid the full amount of the rent for the month that they have been living in the rental property.

i have a tenant that has no written lease, renting month to month a commercial piece of property. has not paid in 4 months. how much time do i give him to leave and what steps do i take, and if he refuses, what legal action can i take. thanks drew

Moved into a 1 family home-which is owner occupied as well as 2 other roommates on 11-1-05. At the time signed a month to month lease (which I was not given a copy of at this point), only put down 1st & last months rent.
After much proding (we had seen mail come in landlords name from MA foreclosure prevention services), landlord finally admitted to us on 12/14/05 that the home is in fact in foreclosure & they have no intention of saving it.
Can they legally have entered into a rental agreement with us based on the pretense that we were going to have a home to live in for the future. I realize it was only month to month lease but that is very common to have. There was never any mention that she was having financial problems or that it was to that point. Do we have any recourse against her for allowing us to move in there fully knowing that hte home was already in proceedings?
Also, I realize we do not have any legal rights as far as the bank is concerned..but do they need to be made aware that we live there? or at the least, the attorney representing them. I am just wondering about notices & such that we should be given as tenants on the property. thanks!
