i have lived in the home i rent for the past 2 years. The lease on the home was signed by friends of tenants over ten years ago. They no longer live in the home. Me and my other 2 roomates have not been on the lease since we moved in. We have been going month to month since. The property management co. has just given us our 3 day notice to pay rent or evict. They are saying we owe for past months that we do not but we cannot prove that we paid since part of it was paid in money orders. how long do we have before they can evict us? do we have any recourse against the property management co?

Holdover Deadbeat Tenant
I gave my tenant a notice of non renewal on a month to month lease. Not only did my tenant not pay rent for the month of October but he also ignored my notice to vacate and is still in the property. I think I have a right to evict for non payment and holdover but someone told me that a holdover hearing takes more time than a simple non payment eviction. Which one is quicker? Do I need an attorney for the holdover hearing?

I have a month to month lease.It states if i am 2 months delinquent with rent i can be evicted immediately.I owe 700 for Jan(out of 1200).And 1200 for feb and now 1200 for march.I gave my 30 day notice to vacate by April12th,as it states i can give 30 day notice to vacate.The landlord is saying that he can remove me immediately,without going to court,just basically saying i will be removed as of March 31st.he also harassed my visitors the other day saying they were blocking the driveway.They were not,and they were just dropping my son off at home,and were in the driveway less than 2 minutes. I am on disabilty as well and am basically trying to vacate and go on a payment plan to pay the remaining rent.The landlord wants no part of it and is saying i will have to leave march 31st.Does he need to go through the courts to eveict me or can he just kick me out?I live in Va.

I re-signed a 12 month Lease on a home Jan 1 2003. The owner didnt want a month to month.
Last weekend the owner served me a 60 day notice becuase he is moving back to California. When I said that we signed a 12 month Lease in Jan, the owner stated that since I had signed it but he,(the owner) hadnt signed it and faxed it back to me, the lease wasnt legal.
Is that true?

We signed a lease in may. The lease was a standard month to month document. The landlord wanted a 1 year lease on the house. She just wrote year to year lease on the top of the document. As we were reviewing the lease we noticed down further in the document in 1 of the clauses that it said that any party may terminate the lease with a 30 day written notice at any time. The landlord did not cross that line out. We let her know that we wanted to move out and she said that we were not entitled to a 30 day notice. Our reason for moving is because the basement has 8 inches of water in it. (it did have about 2 ft. we pumped out as much as we could)and it has visible mold in it. we took my daughter to the er to have a cough checked out that started just after we moved in. they said that it was due to allergies that was triggered by the mold. 3 days later i took her for a 2nd opinion and that dr said that she had pneumonia really bad and that it was due to the mold spores in the air. she said that it was critical to our daughters health that it was cleaned up or that we move. we let our landlord know and she has done nothing to clean it. Are either of those two reasons grounds for terminating our lease early?
