illegal eviction
Can you be evicted for one noise complaint and having lights on to all hours of the night? My son has a month to month lease contract, has only been there 19 days and all of the sudden is told he must be out by the time the rent is due in a week and a few days!! Can they do this or don’t I have at least 30 days so I can find another place to live? Wouldn’t I be due my rent /or portion of rent back since I didn’t get a whole month?Plus my deposit? Month to month tenants need more time….HELP!
We are currently renting an apartment on a month to month basis while our home is being built.
We are about 2 weeks behind schedule, and will need to go into March.We told her in mid February we would need more time, and would pay March’s rent. At that time she made no mention of having new tenants coming in right away. We were served with notice to quit papers saying we have to be out by March 1. When I called to see why she explained she has section 8 tenants lined up to come in March 1. We expressed we will pay March’s rent, but she said she is unable to accomodate us. My question is are we going to be homeless March 1? When March 1 comes will there be someone here making us move our things? We have 3 kids, one 6 weeks old. Is there a way to ask a judge to grant us more time? Or are we able to just stay the 2 weeks and move when our house is finished, and mail her the check for March? Help please!

In MA my year long lease expired and I let him know I wanted to extend the lease for another year. Landlord wants to go month to month, I would be a tenant at will and said he would provide a lease as such. It has been 2 months and he has not provided me with a new lease.
What happens to my security deposit and last months rent and do the original terms of the expired lease still apply?

Rent raised before lease is over
I had a 1 yr lease agreement from 11/1/04 to 10/31/05, after which it would be month to month.
My landlord sent me a written notice on 7/25/05 stating that my rent would be raised after 9/1/05. I called the landlord’s office to explain that my rent cannot be raised in the middle of my lease term. The office person verbally told me to disregard the written notice.
It is now June 2006. I am renting month to month now at the same original rent, and just received a notice stating that I have an outstanding balance because I have not paid the full rent amount for the past 9 months, citing the written notice that they had sent to me (before my 1 yr lease was up, and even though I was told to disregard that notice).
My questions are:
1) Is this outstanding balance legal?
2) Am I liable for any monthly increases after 10/31/05? They told me to disregard the increase notice, and they have never sent me any other notices notifying me of an any increases.
