evicting a renter
i have a tenant who is 4 months behind on rent. it is a month to month with no written lease. can i just send them a letter and tell them they have 30 days to vacate. or do i have to do it through legal channels

Apt. problems
We are currently on a month to month after out lease was up this year on our apartment. We recently had some new neighbors move in downstairs from us and their kids stay up all night even on school nights on average till about 2:00 am. We have made multiple call complaining about the noise to the mananger but the problem still persists. There is a 10:30 pm quiet time rule in our lease. It will be too expensive for us to move right now and we dont want to leave the area! Is there anything that we can do?

Lived in this apartment 14 years, on month to month lease. About 10 years ago owner turn apartment complex over to a management company. Every year all tenants receive notice on door to clean up there balcony and car ports. They do not like seeing bikes on balcony or things stored under carport except car. After reading my lease stateing PARKING/STORAGE RULES I did not see anything restricting storage except disabled cars. Last notice I/tenats received was a letter stating that a dumpter was being brought in and if items were not removed from under carport they would be thrown in dumpster. Please advise what my rights as a tenant. I feel that I am being intimitaded by the management company.

Commercial Tenant wants to stay 90 days longer than Landlord wants
Moving a dental practice to a new facility. We need to stay in the current space 90-120 days longer than the Landlord wants. We have been in the space for about 20 years, but have been on a month to month lease for about 1 year. If we can not work out an arrangement with the Landlord (ie offering more rent, begging, etc) is there any legal recourse that we have or any legal action we can take in order to gain the extra 3-4 months that we need to stay in the space.

Small claims, security deposit
I have a tenent in Florida on a
month to month oral lease, i.e. no
written contract. He paid me 300 a
month for about 2 years. He gave
me one week notice and moved out
on the 7th of November. He never
paid me the rent. He also ruined a
carpet, dog ripped up a small patch,
and never fixed a hole in the wall.
Problem is I never claimed the rent
on my taxes. Can I take him to small
claims and expect to win if I claim his
income from this year on my next
years taxes? He never gave me a
deposit, paid me mostly in cash,
although i have some checks, maybe
5 or 6 and his mailing address was
kept at my house over that period of
time. Just don’t want to get screwed
because I never claimed the taxes.
