I have a tenant, and I have continued to accept less than required amount of rent, the lease is finally up, and has not sucessfully been fulfilled, and now she is staying month to month and not paying as agreed. I agreed to allow the tenant to split the rent to make it easier on her. yet again, last month she only had half on one of the installments. I made her sign an agreement that I would accept it, provided she paid the remaining amount, along with the next installment plus a late fee or she had agreed to move out by 12/31/09. She owes 675 for august, owes 225 for november and now owes 450 for first half of december and by the 20th will owe the other installment of 400 for december. I really want her out, but can I accept December’s rent, then evict her for past due amounts? I know normally I cannot collect partial past due rents if I am going to evict, but she is planning on staying thru the end of the month, and am I not entitled to rent for THIS month?

We are two months behind in our rent. We have been paying the landlord off little by little. Now he is threatening to turn off my lights and telling me that i have to leave in 20 days. We have been living there for three and a half years. He doesnt fix the apartment. I have mold issues in my bathroom. None of my windows open properly. and the ceiling in the hallway is about to cave in because of a leak that happend about six months ago and the light switch because of that leak is shorting out. I need to know what my rights are as far as this situation is. Im not going to let him stronghold us. We do not have a lease we are paying him month to month. Is this legal?

I was evicted because I was a month to month tenant and the landlord didn’t want me to stay there anymore. I stayed past the 60 days, and was subsequently evicted as I felt it was retaliatory; however, the judge only ordered that I get out, no monies, back rent or anything as I was not in arrears. Will this show up on my credit report even though I don’t owe any money.

Notice to Move from Rented House
I have been renting a house for 4 years (one year lease that rolled over to month to month) and without any notice by the owner, the owners informed us that they were selling the property immediately. This was done via a telephone call at 9:35 in the evening and followed up with a written notice of 30 to 60 days to vacate.

We moved as fast as possible and are in Escrow on a house.
– What rights do I have left, if any? – What are my rights now? We have accomodated open houses, individual showings of the house, termite inspections, etc. Now they want to do the extensive termite work while we are still there. – Do we have to let them do this work? Also, our 60 days ends Thanksgiving weekend but they want us out of there before that – like the day our escrow closes.
