No signed copy of lease?
Our one year lease ends in a few days. 2 months ago, property manager asked if we were going to sign for another year. We said yes, he faxed the lease, we signed and faxed back. To date, we have received no copy signed by the owners. 2 days ago, the prop manager’s daughter (who is taking over for dad who retired), called to say the lease had a ”mistake” and the owners no longer wanted to pay for lawn care. We said, too bad, so sad. She then said that the owners never signed so we had no binding contract. We said fine, we wanted to buy a house anyway (which is true), so she said we were going on a month to month. We indicated we wanted a signed document saying we are now on month to month and that we are released from the other lease since they still have the copy we signed two months ago – what would keep her from getting the owners to sign?

Tonight, I pulled out the lease we signed and noticed it already says that the tenants are refusing to pay for lawn care for the new lease. So I’m thinking she doesn’t even HAVE the copy we faxed (lost by her father?)

What’s our best course of action to insure we aren’t locked into another year and we ARE month to month?

I have a month to month rental agreement on a small single apartment. I pay $650.00 per month, and have been doing so since I first moved in a year ago. I have just found out that I am the only one being charged this much. Other singles in the apartment complex go for $550.00 per month. The one bedrooms are priced at $650.00 per month. After finding this out I asked the on-site manager if he could either lower my rent to the $550.00, or let me move into a vacant one bedroom and pay the same amount. He said no to both. Is it legal to charge different rents on the same apartment, excluding such factors as section 8 and rent control?

I’m currently in a 1 year term lease that will expire May 31st 2005 (in 2 weeks basically), with 3 other roommates on the lease. I’m planning on moving out before this time, and I have already gave notice to the management of my plans and signed a roommate release form 30 days ahead.

My question is, if my other roommates choose to stay after May 31st, am I legally obligated to find them a replacement roommate or be responsible for month to month rent until I do so? The management indicates that this is the case, indicating that we all signed the original 1 year term lease together, but it seems kind of fishy to me.
