My daughter is disabled and lives in my home in TX with her boyfriend. He is mentally and emotionally abusive to her. I have told him several times he needs to stop being verbally abusive to her and the agreement with my daugher was that he would live there and help take care of her. He does not help her and has done nothing but mooch off her and take advantage of her. She is bi-polar, has fibromyalgia and panic disorder. He calls her names and intimidates her. He and I had a verbal agreement that after 3 months on his job he would start paying rent. He has been on his job now over 8 months and still says he can’t help with rent. My daughter has told him to leave and he refuses. I have had 2 complaints from the manager of the community regarding his dog. He has a very large dog (part pit bull) and the dog is very intimidating and neighbors have complained. I have told him the dog has to go and he has refused to get rid of the dog. Can I get him out with a Notice to Quit? I called the JP office and was told I needed to give a 30 day eviction notice but if I do that he will steal everything my daughter owns. He has stolen money from her purse previously. He also has a warrant for his arrest in Oklahoma. Can you help?

Vacating premises without Notice to Quit.
I have a homesteaded duplex and I rent to an unmarried couple with a child upstairs for more than two years now. I have given a Notice of Rent increase of $100.00 3 months in advance to cover costs for taxes and utilities. Right now I have a suspicion that they are preparing to move without any warning. Under Minn. §504B.135(a)(1999), Notice of tenancy at will to give a notice by law of termination within the 30 days of the month-to-month lease. See Oesterreicher v. Robertson, 245 N.W. 825 (Minn. 1932). They are low income renters, as well as my family. I have a pre-lease signed agreement and photographed documentaion of the unit prior to renting. What other course of action will I need to protect myself in case of concillation action, if they try to skip out or try to use the security deposit as the final rent? I know that a written notice from the renters must be given and that using the security deposit as rent is illegal and I can request for the demand for payment of rent for Dec. 2004. See MN. §504.20 subd. (7)(a) (1992). Will my suspicions be construed as constructive notice to vacate without a accepted waiver by verbal notice, or a written notice required by law? What is my full remedy? The damage is more than normal wear.

I moved in with someone (replacing a departing roommate) almost a year ago. In that time, I have written rent checks directly to the management company / landlord (it’s a 4300 unit complex), always the full amount due and if not on time then within the lease-provided 5 day grace period, after which a 5% late charge is applicable. (I have all the cancelled checks.) In now reading the lease, it appears the sublet is improper as we did not involve the landlord/management co. (I’m in the process of rebuilding my credit). Reading a Nolo book, it appears we can be evicted after a ‘non-curable’ 3 day notice to quit because we’re technically in violation of the lease. But given my performance, and the landlord/management company’s cashing of checks clearly written in my name for rent on this unit, can we argue ratification of the modified lease should it become an issue? I don’t care about my situation — I’ll find somewhere else if I have to. But my roommate and her son just want stability, and I’d hate to be the one to cause them to have to move!

Eviction Process
If I am to evict a tenant, I understand that a Notice to Quit is required. If I sent a termination letter with much of the same wording would that be adequate or does it have to be a Notice to Quit, and also is this a legal form? If this letter was served to the tenant by a sheriff would that be enough to hold up in court?
