Regain Possession of Property
My wife and I are senior citizens that must sell our rental house in AZ. The annual lease is up 9/30/06, and we planned to terminate our relationship with our Mgmt Co. and our tenant at that time. We informed our Mgmt Co. by email 8/1/06, and our tenant by phone 8/3/06 – not a written notice. We had our realtor visit the house on 8/17/06 to estimate what had to be done to prepare for the sale, and ask the tenant if he wanted to buy the house. As of 9/23/06 the tenant has not found a new home, and says he will not be out 9/30/06. Arizona Landlord and Tenant Act – 33-341 ”Termination of tenancies” A. states ”A tenancy from year to year terminates at the end of each year unless written permission is given to remain for a longer period” and D. states ”When a tenancy is for a certain period under verbal or written agreement, and the time expires, the tenant shall surrender possession. Notice to quit or demand of possession is not then necessary”. My questions are: Do I have a right to possession of the property on 10/1/06? and What should I do if the tenant wont leave?

I rented a room in my home with use of a bathroom and kitchen to a couple of college students and their dog. It went wrong, very quickly. I gave them a notice to quit/vacate on 2/27 so that they must vacate by 3/31. In the interim, they are parking where I ask them not to, running a space heater that I forbid them to have in the house, blowing fuses from too many appliances, letting the dog jump on and scratch up the door, and defecate on the walkway, and refusing to allow me access to their space to show the room (even with notice) by putting signs up stating that they ”will not be home and if I enter they will consider it breaking and entering and contact police.” I feel intimidated and harassed in my own home and do not know where my rights begin and end. There was never anything in writing. What are my rights in terms of room access and enforcing things like parking and electric issues or the heater while I wait out the next 30 days?

Notice To Quit vs. Kappa Notices
I have several tenants who are in violation of their Lease by having dogs in their apartments. We have sent out numerous letters along with copies of the rules and regulations, yet they continue to have the dogs. I would like to proceed with an eviction for violation of the rules but I am being told that my management company can not do this because we have to serve a Kappa Notice and it is required to be drawn up by an attorney. Is this really the case and why can’t I just have my management company file a regular Notice To Quit for violating the rules and regulations and have it served by the sheriff?

we have a 1y lease-have not had issues w/landlord. we rcvd from lndlrds atty notice to quit in 30d-lease states if lndlord may terminate lease but give 60d notice. Notice to quit did not come from a judge, not court date was given. Our rent is pd infull, ontime every mo & no damage has been done to property. no alterations have been done to property, have kept premisis clean, made no excesive noise-have not disturbed othr tnts- have not subleased-have done nothing to break lease agrement. we have not rcvd any kind of warning frm lndlrd in verbal or written form or rcvd a visit from lndlrd stating there have been problems. I am also 8 mo pregnant. What are our rights? We have always been in good standing with our lndlrds and don’t want this put on our record if we so wish to move again. Can they evict a tenant with lease for anyother reason than whats stated on lease? What can we do to fight this and keep our records clean of an eviction?
