Resignation of Trustee (Bank)
Our trustee resigned. They paid themselves a termination fee 4X their normal annual fee. They also paid out, on the last day, attorney retainers – 5X there annual fee. They told the benificiaries that they would return the retainers (but not the termination fee) only if we signed a global release to hold harmless. Is this leagal?

A couple of years back, I personally purchased residential real estate for investment purposes. A short time after purchasing the property, I was approached by a local real estate developer that was interested in my property. The developer owned additional property on the same block and was interested in my property, but he never presented me with a written offer or contract to purchase. That same developer donated his property to the local Village Fire Department for practice purposes, the Fire Department did not only practice on his property, but they also practiced on my property. I never executed any documentation to allow the training and it occured with out my knowledge or consent. My property address was added on to the indemnification and hold harmless that was executed by the developer. I have estimates in the neighborhood of $150,000 – $180,000 to repair damages to the property and I have been unable to rent it. The developer has since left the country. I believe that the Village had some duty to perform due diligence on / with the owner of the property prior to performing training sessions.

My current lease expired in February of 2006. My landlord told me on July 6, 2006 that I am now on a month to month lease. He never asked me if I wanted to renew my lease. Then He tried to enter my apartment without my consent for the building inspector. He says that he does not have a key so he could not get in. I explained to him that it is just my daughter and I living there and I perfer if he told me when he wanted to get into my place so that I could be there in case of an emergency. My apartment was broken into a few days before Christmas of 2006 and he never bothered to call be but he gave my phone number to the police. So now, he tells me that he is going to serve me with a 5 day notice if I don’t get a key made for him. What can I do?

Month to Month Tenant Vacate Notice
I was on a month to month lease until December. On 12/4/08, I notified my landlord i was moving. He stated it was fine and that I would receive my deposit back. He now is withholding my deposit for January rent stating I was required to had to give him notice on 12/1/08 (30 days). I can not find any law that states the tenant must give 30 days notice within the same calandar mohth. Please help.
