No Lease agreement or tenacy-at-will/ Fleas
My girlfriend and I went to look at a house for rent and was shown a house by a couple. As we were looking at the place they were going over the repairs/upgrades they were going to have done. This sounded like an attractive offer after the promised repairs had been done. We also noticed a flea infestation and mentioned it to the owners at that time and were assured that the problem would be remedied. I went ahead and paid my damage deposit with the assumtion we were going to go over the condition of the house before taking residency or signing a lease. The repairs/upgrades were poorly done and there was still a problem with flea infestation. I never signed a lease and never took up residency at this location nor would I have agreed to live in a house in this condition for the price he was asking. We have now had to find alternative living arrangements and the ”Landlord” is not giving me my DAMAGE deposit back and has threatened to counter sue me for lost rent if I take him to court.

I move in Oct of 2003 and signed a years lease. The apartment advertised an indoor pool and fitness center but I was told that it was not finished but ”coming soon.” During the term of the first lease I again asked about the pool/fitness center and was told the same thing. Also during the term of my lease, I became pregnant and wanted to move to a bigger apartment that was also away from the daily commotion of the crack heads that lived below us. So we signed a new lease August 2004. After I signed the lease I asked again about the pool/fitness center and was told by the new manager that it would never be open for use because of some county ordinance that would not allow tenants to use the pool/fitness center as it was attached to the leasing office. I asked for permanent reduced rent for their false advertising but was given a credit for one month. Can I sue for to reduce my rent or terminate my lease agreement without penalty? Thanks!

Typo On Lease Agreement
Myself and two room mates signed a ”12 month and 0 day” lease starting July 19, 2002 however, the end date written into the lease states ” through and including July 31, 2002”
Although we provided the landlord with over 60 days written notice that we would be vacating July 19, 2003, he has advised that he intends to hold us financially responsible up to and inlcuding July 31, 2003.
Please advise who should prevail when a contract contains a typo of this nature.

Can i use small claims. I am a resident in another state.
Please advise if I am able to go to small claims court to pursue this matter. I was told NO because I no longer live in the state this occurred, yet I do own property there.
In Jan 09 I signed a agreement with a property mgmt co. in GA to find a tenant, collect the rent, and oversee the property. The Mgr. is to receive the Sec. deposit & 10% of the rent each month. In Jun 09 I found out someone was moved into the unit. 2M rent, a sec. deposit & app. Fee has been paid to Mgr. The next day he denied what happened. The TENANT provided me with a copy of the lease agreement, money orders purchased and receipts signed from the Property Manager I was using with his signature that they had received funds.
Is this true? I cannot take the Property manager to small claims? The amount I am requesting is $2,550.00 (Sec. deposit. 2 months rent ($850 x 3).
Am I able to req any additional funds to this amount? Can I provide ”My Statement” via phone, fax, internet to avoid numerous flights to GA?
