Executor of Parents’ Estate
My sister was diagnosed this summer with a stage 4, inoperable brain tumor that has impaired her visual, motor and reasoning capacity, especially after a recent round of treatment. She is named executor of our parents’ estate (they are very elderly but still living independently). I am named second ”alternate” in their power of attorneys, wills and living wills. She seems reluctant to hand over executor to me although it is apparent that she will not be able to fulfill her responsiblities. My concern is the length of time it would take to have her declared incompetent should something drastic happen to my elderly parents and a decision be made immediately. What is the process and approximately how long does it take to go through this process?

Divorce Settlement
In my divorce papers in 1994 in Detroit, Michigan, there was to be a quit claim putting the home in my name, which was done; and when the home sold I was to pay my ex $20,000 which was 1/2 of the equity at that time of the divorce. The home has not sold. Actually he is living in it right now. He has made a few updates to it. I have remarried. I think it would be right if at this time the home should be in joint ownership (him & me). He is actually having papers drawn up at this time; however, if I do this, I want to be absolved of having to pay him the $20,000 that the court originally ordered. I don’t want to very kindly give him 1/2 of the house and then be stuck having to pay him the $20,000 if he gets a hair crossed or something. I think it’s a fairly easy thing to do another quit claim, but I won’t sign anything unless I have been absolved of the original $20,000 and I’m not sure a simple paper by an attorney can do that. I have a feeling that there needs to be another court order absolving me of that. Help! (and thank you very much for it!!)

My mother-in-law is adopting her own grandchild, and they told her to get a form which states that if anything were to happen to her such as she pass away or becomes to sick to care for her grandchild that she’s adopting, that who does she want to give parental rights of that adopted child too. What form would she use to have in case something like that were to happen to her. Is it a living will trust or something like that. This is a form that she and the person whom she’s is giving parental rights to are to sign and its states that if anything were to happen to her, that the other person has those rights. This is also so biological parent, knows that the child is to go to whom ever the adopted parent states whom she wants the child to go to. Basically so biological parent does not try to gain custody of child again. thank you.

Am I still responsible for debts that have been refinanced
To whom it may concern,
My question is that, having got divorced inthe state of Arizona, I was or am required to pay half of the second mortgage on the home that we both shared and then was awarded to my ex-spouse in the divorce. Recently my ex-spouse refinanced the first and second mortgages into one. Technically paying off the second mortgage. She now has a new finance company to deal with. Am I now responsible for any part of this new loan, which I have no interest in at all. She never notified me that she was going to do this, as she doesn’t have to because the home was quit claimed over to her after the divorce.

my wife left me after 12 yrs of marriage, it all started when she stopped paying bills and i asked her to put her check into my bank account so we could get caught up,combine incomes,i noticed bills were not getting paid when i got a call at work from her saying the power was cut off and the bill was 1295.00 to put it back on, she has been out of the house for 2 months and gone every weekend for the past 5 months,her son is 17 and will be 18 in september, hes got a jouvinile record, lost his liscence for six months and doesnt work, if i decided to make him live somewhere else, can i lose my house,. i got a quit claim deed in my name and it has been recorded, the morgage is still in both names, ive managed to get caught up on all the bills except for my house taxes, so i dont want to lose my house by doing anything stupid and jeperdising that. i asked my wife is i need to call a divorce lawyer but she says no not yet in the mean time my life is on hold. She says she is still faithful but i have friends and ex co workers of hers saying she has been having an affair for a couple years on me. I want to make some changes step son messing up the house constantly i need to get him out so i can do repairs to the house.please advise
