My children’s future
I am now married and have two chilren from a previous relationship. I was never married to my childrens father. He does not pay child support because he won’t keep a job, he lives at home, he has been to prison a few times and he still thinks like he did when he was 17. He is not responsible enough to take care of my children for 2 days every other week, let alone for the rest of their lives if something ever happened to me. I want to write a ”living will” stating that if anything were to happen to me custody of my children would go to my husband, not their biological father. There is no court ordered custody, I have sole custody of them. He has been to jail for not paying child support. My question is, am I able to do this and would my childrens father be able to fight my now husband if that situation happened, for custody? And also, what procedures to I have to take to accomplish this, if able?
Thank you.

My question: Me and my husband will be married for 10 yrs. in August 2008. Will he be intitled to half of my benefits, and if he has been in the military will I be entitled to half of his military benefits ? Also if I have a living will upon my death and he is still alive will they honor my will?

Terminating rights to adult children
I am a 25 year old part time student who is employed full time, living on my own. My mother, who has filed for bankruptcy, has drug, alcohol, and stealing as recurring problems, is basically completely estranged. I would like to terminate any legal rights she might have to me, so that she can not have access to any decisions made for health care if I were taken ill, she can not have legal access to my children, she can not continue to have access to my college loans. I understand I can make a living will, assign power of attorney, etc, but I want to absolutely cut off her ability to legally make claim on any aspect of my life. Are there any specific steps I can take? I can only find literature on terminating the rights of parents of minors. And is there more I should do other that just a living will, a will, power of attorney, etc?
Thank you.

Legal Guardianship
My husband wants to adopt my children, we have to wait to see if my ex (boyfriend) agrees to this. Someone told me however, that I should have a living will drawn up , that states, if something should happend to me, that my children are brought up by my husband? Is this true? My ex, has no rights to the children as of present, except of course that he is their biological father. There is nothing in writing that he or any court has that he has any legal right to these children.
