Legal Guardian
I have had my granddaughter off and on all her life. For the last 7 months she has lived with me and I have supported her. Her Mother signed a paper today giving me legal guardianship and general power of attorney. It goes into detail about how I can make all decisions for her. We also had her sign in front of a notary that read all of it to her. My question is will this hold up in a court? For now she is perfectly happy for her to live with me but we never know what tomorrow might bring. Money is an issue is the reason we didn’t involve a lawyer.

My divoce was final on 09/16/05. In the termination agreement, my X is suppose to pay me $500 a month for some credit cards. He has made his girlfriend ”general power of attorney”. They said they will not pay, because I owe them for other unrealated things, and are deducting these things from the amount owed to me every month. Do you think I should take him to court for non-payment Per the MTA agreement? I do beleive that these people will just keep thinking of things unrelated to deduct. The total amount that he has to pay is $19,000.00 over 38 months. Please advise. Lynn

Hi, my father is 75 years old and 1 year ago married a 30 year old woman, whose true intentions are unclear to me. I have spoken to my father about assigning me power of attorney over him and he agreed. My questions are which form do I need, durable or general power of attorney? Will this completed form exclude his new wife of making any decisions over him or his personal affairs such as medical or financial decisions? My father doesn’t own any properties or is in any way a wealthy man, my concern is mainly over medical decisions needed at a time when he is unable to speak for himself and also at the time of death for me to be able to keep his ashes after cremation. If a power of attorney won’t exclude her from making any decisions over him, what will?
