i purchased a car from a private party,the advertisement stated that that the car runs well(i have a copy of the ad), i signed an as is bill of sale, and pay cash. i drove it for 9 miles on my way home and the car started to release lots of smoke from the hood, cused by several transmision oil leak. the car needs a lot of michanical work. after several attempts to speak with her, she anwered my calls the next day, i told her that i want my money back, and she said that it is my problem know. do i have a chance to win a small court claim to return her the car in exchange of my money.

Outright Sale of Auto
I bought a new car & someone was interested in buying my old car outright. An agreement was made to get me a chashier’s check on a Mon., & the next day I would go pay off my auto loan & obtain the title. The bank only had an electronic title & I had to pick it up from the DMV. I don’t have leave at work to go, & I get home too late in the evenings to make it to the DMV. Tues., It was agreed with the buyer’s husband to meet on that Fri.(my day off) at the DMV so that I could sign over the title there, & he could go right in for tags & registration. The buyer was still unhappy & wanted the title sooner than Fri. After many phone calls between us, Wed., the buyer agreed to purchasing the car & to til Fri. for the title. I was able to work out with my car pool to get to the DMV in time after work on that Wed. Wed. night, I went to her with the title & a self-created bill of sale. She knew I was writing the odometer reading on the title & signing it. As I handed ther the title she indicated she didn’t want the car anymore. The money was deposited on Mon., it is now Wed. Who’s car is it & is it too late to for her to say she doesn’t want it anymore? Can I mail it certified & be done with it? Or, do I owe her money back?

I sold my ’94 car 1 month ago and am being sued by someone other than the person that viewed/purchased it. Upon purchase they did not test drive it and only looked under the hood after my suggestion. The car was not smogged but I did disclose this information on the date that it was sold. Her uncle has gone through the maintenance records that I turned over and says there are also problems w/the brakes. I did take it in for a check up in Aug. 99 but was told by the service techs that this was something that did not need immediate repair. Unfortunately, I forgot have them sign the bill of sale on the date the transaction took place so I mailed it a few days later and therefore do not have her signature on it. Neither of these people, ever called and asked for their money back they only accused me of lying about the condition of the car. What are my chances that this will get thrown out of court??

Selling of a car
I sold a car to a residence of NC on 12/19. A bill of sale was signed however no money was exchanged. The car was given to purchaser on good faith. Credit union was to send the payment to my finance institution. I paid the remainder balance to my finance insitution and was told things would be done bt 12/28. I call his credit union and is now told he doesn’t want to buy the car. I have a bill of sale and everything and he has ownership of car. Isn’t he legally binded to buy the car because the bill of sale was signed as is and I kept my end of the bargain?
