How do I purchase vehicle with a lien from a private party?
I’m considering buying a Virginia registered vehicle from a private seller. The seller says it is financed through a Texas credit company, and he owes $6K more than the selling price. He intends to pay off the entire loan amount when he sells the car.

He will give me a bill of sale, and says I can send the check directly to the credit company. The credit company provided him a loan payoff statement, but the statement does not show a VIIN (for seller’s safety supposedly).

Is there a way to eliminate or reduce the risk associated with buying a car when it has an existing lien in excess of the vehicle sale price?

I live in CA and the buyer of my car lives in CO. He flew out, I showed him the car revealing everything about it to the very best of my knowledge. He signed a Bill of Sale clearly stating ”as is no warrenties expressed or implied.” He drove the car for close to two days then ran it out of oil blowing the engine. He had the car towed to his home and stopped payment on the check. He wants to renegotiate a ”fair price” since he thinks it isn’t worth the amount he bought it for. He has mechanics claiming the interior of the engine was rusty and it never had oil (not true since I filled it and the gauge read full at the time of the sale). I found out I will have to go to CO to file a small claims suit and I want to know if he is obligated to pay me because the sale is ”as is”. He has my car and my money. What are my legal rights in this matter?

Selling a dealer purchased car
Is it usually a problem to sell a newly purchased car that I bought from a dealership? I looked at the bill of sale and it says something about not selling the car for 6 months, but it appears that I would only be liable for any additional charges from the manufacturer (rebates not going through etc). Are you familiar with this? Should I be concerned about selling the vehicle if I am not making a profit (sales price = loan payoff amount)
