We ordered from Jostens in Mesquite, TX, to get just the cap and gown and tassel for my son’s graduation on 5-30-09. We paid $65.92. In the past upon purchasing such a commemorative item, once you bought your cap and gown for graduation, it was yours to keep! On yesterday, when I am supposed to be full of glee for my son’s graduation, it was turned into a huge mess! My son was told that in order to receive his diploma that he had to give them his gown. The Jostens Rep stated that it was a rental agreement, and I told him according to the paperwork that we have, it said nothing about a rental agreement, and furthermore we would have never agreed to such a thing! It sounds to me that they are refurbishing these gowns to other students and they are not new upon purchase! We’ve ordered from Jostens in Illinois & North Carolina and what we bought was ours to keep! If my friend had not taken my son, to get his graduation picture for me prior to him going to the ceremony, I would have not gotten this once in a lifetime photo of my son in his graduation attire. This is very disheartening and (theres more to this, but it all would not fit) what can be done about this?

Verizon and AFNI collection scheme
I moved to FL in 96, am registered to vote here and have a Homeowners Exemption on my principal and only residence since 1996.

In sept 07 I received a collection letter from AFNI saying I owe them $121 for a Verizon bill in Calif in 2000, well after the Statute of Limitations ran out in CA.

It seems AFNI ( in IL ) routinely buys huge portfolios of Verizon’s stale debt – this one in Sept of 06. So many they’re a yr behind !

Problem is, the service in CA was ordered & used by someone else ! I’ve never been NEAR the city in question let alone know anyone there.

I researched, found it was an apt bldg. The resident mgr was there in ’00 and will give police the rental agreement proving it was NOT me and ID’ing who it really was.

Verizon’s fraud department has ‘disassociated’ me, however they say AFNI now owns the acct, has all the paperwork, and it’s out of Vertizon’s hands.

AFNI has repeatedly denied me rights, incl acct paperwork, I have under the FDCPA, admit they can’t collect or report this acct even it WAS mine, but REFUSE to accept my affidavits of fraud, saying they have ‘Validated’ the acct as mine.

I want to sue AFNI & Verizon for engaging in this extremely outrageous scheme. Can I ? How !

When can you break a lease
My girlfriend and I were attacked by her ex-boyfriend at her current resedence. He broke in and tried to hit me with a 2×4. He has a history of coming to her place, sometimes acting violently and hurting her. He was arrested this last time. If he is released, she wants to move so he doesn’t know where to find her. Is this a good enough reason for her to be released from a rental agreement?

Rents for new tenants are substantially low($1000) when compared to the renewals($1100) in my apartments. However I came to know that the manager had rented one apartment for $1050 when they are renewing the lease. I asked her for the same rent for my renewal. I told her my friend who had signed the lease 10 days ago had told me that he had signed it for $1050. Yesterday she called my friend who had signed the lease for $1050, and asked him to vacate the apartment because he is telling everybody that he is paying 1050, and everybody is asking her for the same rent. The problem here is he didn’t have a copy of the rental agreement. He had signed the agreement on Aug 1, and paid $1050 as the rent for the month of august. But the manager didn’t sign the agreement till now. Yesterday she called him to the rental office and crossed off the agreement and she had written VOID on the agreement and asked him to vacate the apartment. Is it legal to evict a tenant just because he told his friends how much he is paying? Once agreed on rental terms, how long can a manager keep the rental agreement with her without signing and returning a copy to the tenant? Can a manager cancel the rental agreement by just writing VOID on that?

Signatures and Lease Agreements
An apartment complex I moved out of 4 years ago is trying to make my pay for breaking a lease with them. The lease application listed an eight month lease which we signed and paid a 199 deposit. The rental agreement is two pages long and has the dates of the rental agreement on the first page. The dates on the rental agreement are for 10 months. Our signatures are on the second page of the lease agreement. I dont agree with signing a 10 month lease. Is there any law that requires signatures or initials by dates, or atleast on each page of a lease?
