Last November I was looking to purchase a jeep from a used car dealership in Plaistow N.H. The salesperson guaranteed the jeep was in excellent running condition and would pass Mass state inspection, he even went as far as to tell me I could take the jeep to my mechanic for him check it out. I wrote a check and took the vehicle to my mechanic for him to go through. He told me the vehicle was no good, that I should not buy the jeep. I brought the jeep back to the dealer and asked for a refund. The dealer asked for a chance to make the vehicle right, assuring me his mechanics would go through the vehicle thoroughly. After waiting a week for the dealer to get back, I called and got no answer, nor did I receive a return call in response to the messages I left. I then drove to the dealership, removed my plates from the jeep and left a letter to the salesperson explaining that I took my plates and I expect a refund check in the mail.

Two months has passed in which time I have called the dealership several times in an effort to get my money back. I have several messages on my phone from the salesperson saying they would refund my money, yet they still have not done so.

They have the title, the jeep and my money. I have a bill of sale and a copy of the cashed check. As of late I have noticed they have the jeep up for sale on Craigslist they apparently are trying to sell it again.

I guess my question would be… Is there anything I can do about this? If I have to take legal action, can I sue for the attorney fees as well?

Car dealership misrepresented vehicle specifications
In March of 2003 I bought a 2000 Saturn from CarMax, a national used car chain. CarMax advertised this vehicle as a Saturn LS-2 with a V6 engine. The sticker, bill of sale and the financing contract all state LS-2. Nine months after owning this vehicle a Saturn dealership informed that the car is actually a LS-1 4 cylinder. I actually paid the LS-2 V6 price! The price of the car was $12,599. The warranty was $1,599. With all appropriate taxes and fees the final price was approximately $15,000. I paid $5,000 down on the car and financed the rest through Bank of America. The financing paperwork also states LS-2. I took the car back to CarMax and they admitted that they misrepresented the vehicle specifications and it was not a ”paperwork error”. They apologized and offered to buy the LS-1 from me for $10,000. I would loose $5,000. Is this contract valid? Should I expect the dealer to put me in a LS-2? Should the bank know that they are not financing the vehicle they thought they were? How should I proceed?

I recently bought a used lexus from a private party in new jersey (i live in new york). The car seemed to be in excellent condition. After failing the NY state inspection due to emissions, I took the car into a lexus dealer and had them run diagnotstics. They came back with a grim report – about $6,000 dollars worth of work needed! I paid $8200 for the car. Lexus had no records of previous service or maintenance with the previous owner, so I can’t prove he knew anything was wrong with the car. I called him after I found all this out and he said he thought the car was in great condition. The repairs needed range from leaks in several different components, cracked motor mounts, full tune-up needed (past due), alternator, and more.

I don’t think an ”as is” bill of sale was signed, unless there was a clause like that on the back of the title.

Do I have any options? (other than paying for the repair).

Selling my car as-is
I sold my 1998 mazda mpv on craigslist on 4/12/08, about 3 weeks later the person is harrassing me stating the van has a major oil leak. I sold it with a smaller leak that I told him about and put in the ad. He is convinced I knew about this huge leak and lied to him about it due to a post he saw on a Mazda website from me a few months back which is not related to whatever leak he has now. I did not right as-is on my bill of sale; but didn’t give him any form of written warrenty either. What will happen at this point if he trys to sue me?
