Power of Attorney – No Heirs – Bank Accounts
I had power of attorney over my friend who has since passed away. She had no living realatives or heirs. She has $80,000 dollars in the bank. I keep getting letters from the bank about inactivity. This money is going to be taken by the government. Is it okay for me to take it instead with out any legal recourse?

To use the POA after death would be against the law so I would not encourage that. Probably better to start a probate and do things legally. At least you would be entitled to the Administrators fee of about $3,500. Contact me if you need an efficient lawyer. I guarantee that this woman had relatives, even if they’re 3rd cousins twice removed. And if you take the money for yourself, you will be violating the law.
You need to probate this estate, whether you want to or not.
