I am trying to apply for guardianship
over a man whom I have been his
caregiver for over 3 years. He has
no family. He does have demantia.
He already has amedial durable
power of attorney, but she is abusing
her power. If I were able to prove
this in court would I then be able to
have her removed if I was granted
guardianship? I know I could no
longer be his caregiver. He has short
term memory loss but is able to
make some health care decisions.

Nursing home bill
I signed a contract (as power of attorney) when I admitted my grandfather to a nursing home in 2007. They misfiled for Medicaid and it took several months to get it started, now they want me to pay the bill personally and have a bill collector trying to collect. They mislead me into thinking I had to sign to get him admitted. I don’t think I should be liable to pay. Please advise.

I have a friend who has property in trust to him from his girlfriend of 25 yrs . He forgot what will happen to her if he dies first, he has asked me to become her guardian and wants to give me power of attorney to take care of her in case something happens to him. She has no family. He also wants to give me her house if she dies . iI am have no idea if this is going to be a problem . He is 87 and in very good health and as sharp as a tack . She is frail and has mild dementia . He has a power of attorney over the entire estate . I am just a friend . I dont want any problems. there is enough money to maintain her home and have a 24 hour nurse to care for her, So what is it I will need to help her maintain her ability to keep her in her home . and since I gave my word to help them both what do I need to do to keep my word and assist them both. He has a family if she passes on and they will care for him . It is her that he is worried about. I don’t like breaking my word . But I am confused on what I need to do. There re no relitives for her and it is very sad.

I would like to knwo what the difference is between these two terms. I am translating a document in which a person must submit a power of attorney or (I think) a proxy letter. The terms in the foregin language both seem to mean power of attorney. It would be helpful to know the difference so that I can apply this knowledge to my translation.

I’m the executor of my mother’s estate. She died this week. My brother and I are in disagreement as to day and time of burial. He had power of attorney while she was alive. Now that she is passed on, which of us has the right to determine the time and date of her funeral.
