I own a mobile home which was totaled during a move. We received a settlement from an insurance company. We verbally negotiated a settlement with the finance company, which was lower than the actual pay off amount. We sent them a cashiers check, marked paid in full, which they accepted and cashed. Now they have refused to give title to the home and claim we still owe them a balance. They are a large corporation. If they accepted and cashed the check is that a binding settlement?

I have served a 3 day notice to pay or quit which was ignored, ahd I live a mobile home park. The park has served her a 30-60 day notice. The have partially moved the belongs out, and there is no electricty or gas to the home. They are at present 6 months behind on the park rent and 6 months behind on the payment to me to purchase the mobile home. I have payed the mobile park the back rent in order to save my home.
I posted an belief of abandament on the door, and gave them contact numbers where I could be reached. I arrived at the mobile and found that they had broken the front door in, and immediately called the police. A report was not made. The following day they called the police wanting to know how to get into the mobile home, and were told to go to the front door that they broke down.
They left a hand written note that they would have everyting out in a couple of days. It has now been 4 days including the weekend and the holiday.
What are my legal options and get into the home and remove their stuff.

Warranty Deed Protection
We bought a mobile home 15 yrs ago and got a notorized Warranty Deed and now that we are trying to finalize a sale of the property a deed issues arose during the title search. We have been told we will need to quiet the deed and will need to put $5000 in escrow for the lawyer. Does the Warranty Deed protect us and make the person who sold us the mobile home financially responsible and if yes, if the man is no longer alive, is his spouse, who signed the deed also, responsible to clear up the title issue? Thanks.
