No Lease agreement or tenacy-at-will/ Fleas
My girlfriend and I went to look at a house for rent and was shown a house by a couple. As we were looking at the place they were going over the repairs/upgrades they were going to have done. This sounded like an attractive offer after the promised repairs had been done. We also noticed a flea infestation and mentioned it to the owners at that time and were assured that the problem would be remedied. I went ahead and paid my damage deposit with the assumtion we were going to go over the condition of the house before taking residency or signing a lease. The repairs/upgrades were poorly done and there was still a problem with flea infestation. I never signed a lease and never took up residency at this location nor would I have agreed to live in a house in this condition for the price he was asking. We have now had to find alternative living arrangements and the ”Landlord” is not giving me my DAMAGE deposit back and has threatened to counter sue me for lost rent if I take him to court.

You have a case and he can’t counter-sue you without a written lease. The question is, would it be worth your while to pay the filing fee and take the time off work to go to court? Only you can answer that one.
