Mother adds daughter’s name on her house
I was just told today by my 81 year old mother-in-law that she added her 35 year old daughter’s name on her house in Jan 07. Now she is sorry that she added the name and wants it taken off because there was undue influence, the recent loss of another daughter, and she didn’t know what she was doing. I have durable power of attorney for my mother. Is there any way that I can reverse the addition of her daughter’s name by using my durable power of attorney?
Re: Mother adds daughter’s name on her house
I would need to have some more information. Are you the 35 year old daughter’s husband? You also indicate that this woman is your “81 year old mothe-in-law” and later that you have a durable power of attorney for your “mother”; I’m not sure if this is a typo. The answer may depend on when the POA was executed and how it reads. Lastly, if the 81 year old, or other interested persons, can show undue influence and lack of capacity, etc., she may be able to have the deed voided.
