How binding is a Living Will and to what extent does a helth care provider (nursing home) have to comply with the will? Also, what are the responsibilities of the person who has durable power of attorney have in concern with the living will and the wishes of the person who has had it drawn?

A living will, if properly written and executed, should be binding on the health care provider. Depending upon the powers granted in the durable power of attorney, the person holding the power of attorney could be responsible for making sure the health care provider is aware of and has a copy of the living will.
