i bought a used mobile home in 1998 it fell apart danger to live in i moved out could not pay for it, they told me there was a judgment on it years ago, today i get a letter from a lawyer telling me he is going to take me to court for this i think value of 35,000 and they will take my furniture and ect, i own nothing and rent own no property or hve savings, is there a limitation on when they sue me for this trailer, i called and told them to come and get it back in 1999 for it was falling apart they did not want it. what do i do? when i divorced last my attorney advised me it would be better to let creditors file judgements than file bankruptcy. should i be worried, or is like a small claims court where you go before a judge, what can they do

    Statute of limitations may not apply in your case if they got a judgment as the judgments are normally abstracted for 10 years and can be renewed again and again. You do have few options i.e. settle for less, file for bankruptcy and/or let it sit if you are judgment proof. In Texas they cannot take your personal assets upto a certain amount, but they can harrass you with annoying calls and/or with intrusive and threatning discovery process. If you have other debt and don’t make much, I would suggest filing bankruptcy as it will legally get you out of the debt.
