I moved out of my property at the beginning of December…I had a lease agreement with them that ended 7/28/09 and we never signed a month to month lease agreement..They claim that I owe them two months rent because I didn’t give them a sixty day notice but it didn’t say that in the previous lease and I believe it is Ga state law that you have to sign a month to month lease…that stipulates the terms of ending the agreement before they can charge you for something you don’t owe. I also got a move out inspection report that they never even invited me too and they have all these ridiculous charges because most of the problems we had when we moved in were never fixed and the are trying to charge us for stuff they claimed they didn’t cover when we moved in..I need some advice what to do as they want over 2000 dollars when my security deposit should cover any cleanup costs…Thanks and I hope to hear from you soon
There is no requirement that month to month leases be in writing. Almost every lease agreement contains language that deals with the rules if you stay after the lease expiration. Since no one here has read your lease, and you have, you already have the answer in your paperwork and none of us have seen it. With $2000 at stake, you need to see a lawyer to determine how to respond.
