Firstly a proper notice to vacate the premises must be served on all occupants of the apartment before you can serve a valid petition on them. This procedural technicality is among several that must be carried out to a tee or you can encounter serious problems and delays in your attempts to evict. It is for these reasons that it is highly reccomended that you retain legal counsel to initiate the proper notices and summary proceedings. The slightest misstep or oversight can easily result in you having to start all over from the beginning of the process.
