I am wanting to find out if an insurance must pay double indemnity when an employee dies from a heart attach while at work. the employer is aware of a heart condition and hypertension from a dept. of transportation medical evaluation. The doctor knowingly issued a medical card after noting heart disease and hypertension. She apparently had a heart attack while driving and was able to stop the truck before it wrecked, her body was recovered from the drivers seat.

The terms of the insurance contract covering the deceased will decide whether double indemnity is to be paid or not. If the terms are unclear or ambiguous then a judge may have to make the decision. You may want an attorney to review the insurance contract to assist you with an evaluation.
