defaulting on payment in MTA
My divoce was final on 09/16/05. In the termination agreement, my X is suppose to pay me $500 a month for some credit cards. He has made his girlfriend ”general power of attorney”. They said they will not pay, because I owe them for other unrealated things, and are deducting these things from the amount owed to me every month. Do you think I should take him to court for non-payment Per the MTA agreement? I do beleive that these people will just keep thinking of things unrelated to deduct. The total amount that he has to pay is $19,000.00 over 38 months. Please advise. Lynn

Your ex spouse cannot resort to self help and reduce the amount payable based on speculative claims that he is owed something else. He is in contempt and you may file a Motion seeking a finding of contempt, attorney’s fees and performance.
