Dear Sir

Need one Clarification in Buying an empty Plot in India (chennai ) :

1) Party ‘X’ given General Power of Attorney to Party ‘Y’
in 1986 – Registered in ‘X’ office

2) Party ‘Y’ given General Power of Attorney to Party ‘Z’
in 1986 (2 months later) – Registered in ‘Y’ office

3) Party Y Sold the property to Z

4) Now Z is having Patta in his name for past 15 years with all Tax paid.

Can I buy the property from Z…? Is two General Power of Attorney is a problem?

  1. Yes, you may buy from Z if the PoA in his favour is still valid.

  2. If in the PoA of X, owner has given clear and absolute powers of sale of property to X as also given power of appointing another attorney for and on behalf, then there appears no problem.

  3. If any condition mentioned in the GPA given to Y that Y can not give GPA to another and only to make the property registered then its not valid otherwise there may not be any problem with all the transactions.however scan all the documents to my email id rk1080@rediffmail.com
